Pennsylvania’s Zero Tolerance Laws For Drug Impaired Driving
In the state of Pennsylvania, it is against the law to drive under the influence of drugs. Criminal charges can even be filed for driving under the influence of prescription drugs. In addition, under Pennsylvania’s zero-tolerance rules, there doesn’t have to be evidence of impairment.
Even a trace amount of a scheduled controlled substance in your system is enough to result in a conviction for driving under the influence of drugs, also known as a DUID. If you have slight traces or any measurable amount of a Schedule I controlled substance or a Schedule II or III controlled substance that has not been prescribed, you can be charged and convicted of drugged driving.
Penalties For Drugged Driving
The Penalties for driving under the influence of drugs are the same as those for the highest BAC tier of each DUI level.
- A first offense is charged as a misdemeanor, and penalties can include up to six months in jail, a maximum fine of $5,000 and a 12-month suspension of your license.
- A second offense is charged as a first-degree misdemeanor, and penalties can include up to five years in jail, a maximum fine of $10,000 and an 18-month suspension of your driver’s license.
- A third offense is charged as a third-degree felony.
