David Cassidy was charged Wednesday night with a felony DUI. According to police, they were conducting a DUI checkpoint overnight when they stopped Cassidy’s car for “failure to dim his oncoming headlights.”
Cassidy had a .10 BAC when he was arrested by Officer Tom Jones. He was transported to Renesslaer County jail where he posted $2,500 bail. This DUI is even more serious because it will be charged as a felony because Cassidy was convicted of a DUI in Florida in 2011.
It is important to remember that DUIs are always more serious if you have prior DUI convictions. Pennsylvania has a ten (10) year look back and Florida has a lifetime look back period. That means all prior DUI convictions in the state’s look back period are factored into your sentencing on your current DUI charge. Successful completion of ARD for a DUI does not exclude it from the state’s look back period.
